What is DIN surrender?

Regional Director after satisfying with the reason based on verification of documentary proof attached with the submitted application in form DIR 5 and the requisite fees for any person cancel or deactivate the DIN.

Why we need to surrender DIN?

What is the procedure for Filing Form DIR-5 for DIN surrender?

"Person wishing to surrender a DIN can file Form DIR-5 with the MCA. In Form DIR-5 the following information must be provided by the applicant:
* Any DIN Number held by the applicant
* Reason for surrender of DIN
* Whether DIN holder is retaining any DIN
* Number of DIN(s) being surrendered by the applicant
* DIN Number to be surrendered
* Digital signature of the person surrendering the DIN.
Note in case of demise of a person, or he has been declared person of unsound mind or adjudicated as insolvent, DSC of a related person is used"

How to check whether person having two DIN?

Go to MCA website Link: http://www.mca.gov.in/
• Log in by your user ID on MCA website.
• Click on “Companies/LLPs in which a person is/was a director/Designated Partner”
• Click on Search Button in from of DIN/DPIN
• Mention the Name, Father Name and Date of Birth and search.
• MCA will display the DIN No. allotted to you.

Proprietor

  • PAN (Permanent Account Number) of all proposed directors (Self attested)
  • Identity Proof (Voter Id, Passport, Driving License) of all proposed Directors. (Self attested)
  • Latest passport size Photographs of all directors.
  • Address proof with Present address Mobile bill OR Telephone bill OR Electricity bill OR Bank Statement not older than 1 Month (Self attested)

One Person Company

  • PAN (Permanent Account Number) of all proposed Share Holders (self attested)
  • Identity Proof (Voter Id, Passport, Driving License) of all proposed ShareHolders (Self attested)
  • Latest passport size Photographs of all Share Holders.
  • Address proof with Present address Mobile bill OR Telephone bill OR Electricity bill OR Bank Statement not older than 1 month (Self attested)

KEY ASPECTS OF DIN SURRENDER

Incorrect to hold multiple DIN

As per section 155 restricts a person to apply multiple DIN. If he does so it shall be punishable offense u/s 159 of Companies Act. The Act allows fine up to Rs.50,000 and imprisonment for maximum 6 months). While surrendering the 2nd DIN is the only one that can be surrendered.

Which of the duplicate DIN to surrender

If a person has multiple DIN, then only the oldest DIN to be retained and others to be surrenderd. There is no other choice available. In on the cancelling DIN there is any record of directorship exist, then all such records will be moved to the first DIN.

Single DIN can be surrendered .

Yes a person can surrender his single DIN only if he has never been appointed as director in any company and said DIN never been used for filling any document with any authority.

Inactive DIN surrender.

In order to make a voluntary surrender of a deactivated DIN, the holder must activate the DIN by filling DIR 3 KYC and after it is activated then proceed for surrender as per the rule.

What if Multiple DIN’s are in Possession

Possession of more than one DIN by any person is considered a grave offense as per the provisions of Section 155 of The Companies Act, 2013. Anyone found to be in possession of multiple DIN’s shall not be given relief and strict action would be taken against him by the Central Government.
